Auburndale Nursing Home Abuse Lawsuit & Citations: Bartow Jury Awards $114 Million
According to the Ledger.com, on July 20, 2010 a Polk County, Florida jury at the court house in Bartow rendered a verdict of $114 Million dollars in a nursing home abuse case. The nursing home neglect attorneys apparently alleged the nursing home located in Auburndale knew the plaintiff was at risk for falling but did not put in place proper fall prevention measures. The plaintiff fell, suffered head trauma, fractured her arm, became malnourished, dehydrated, and developed pressure sores before she died.
The article did not go into detail, but I can tell you as a Tampa nursing home abuse lawyer that most of the large jury verdicts in cases like this involve allegations that the facility put profit over people. Often, former staff members testify that there was not enough staff to take care of the nursing home residents, that they complained to management about the need for more staff and that management did not increase the number of staff. It is not clear at this time if that kind of testimony was presented in this case.
