What is Truvada?
Truvada is an antiretroviral drug used in the treatment and prevention of HIV. The active ingredient in Truvada is Tenofovir Disoproxil Fumarate (TDF). Created and marketed by Gilead, Truvada in combination with other drugs suppresses the damaging effects of HIV in HIV positive individuals and prevents it from causing AIDS.
Truvada for PrEp (pre-exposure prophylaxis) is Truvada taken daily by HIV negative persons to reduce the risk of getting HIV-1 through sex.
Truvada has been called a miracle drug because it is so effective in suppressing the devastating symptoms of HIV and has helped prevent the spread of AIDS. But Truvada can cause severe damage and lawsuits against Gilead allege it not only knew the drug would cause this damage but decided to market it instead of a similar drug it owns for the sole purpose of increasing its profits.
What Damage Can Truvada Cause?
Truvada is linked to causing damage to kidneys, lactic acid build up in the blood (lactic acidosis), severe liver problems, and bone damage.
Kidney Injuries Alleged in Truvada Lawsuits
The medical literature suggests a strong link between Truvada and Truvada for PrEp and Kidney damage. The lawsuits allege Gilead knew Truvada and other TDF drugs would cause these injuries even prior to selling them but did so anyway. Types of Kidney damage caused by Truvada include:
- Chronic Kidney disease;
- Declining Kidney function;
- Kidney failure;
- Fanconi Syndrome;
- Acute Kidney failure; and
- Acute renal failure
Bone Damage Alleged in Truvada Lawsuits
The medical literature suggests a strong link between Truvada and Truvada for PrEp, and damage to bones. The lawsuits allege Gilead knew Truvada would cause these injuries prior to selling them but did so anyway. Types of bone damage caused by Truvada include:
- Decreased bone mineral density;
- Bone fractures;
- Tooth loss;
- Tooth decay;
- Dental problems; and
- Bone loss
Truvada Lawsuit Allegations
The first lawsuits alleging Truvada was harming patients were filed against Gilead in May of 2018. The lawsuits allege the active ingredient in Truvada, TDF, causes serious side effects including kidney damage and bone damage. Not only did Gilead know this at the time it started selling the medication, but the Truvada attorneys allege Gilead had already developed another version of the drug that does not pose the same risks of kidney problems or bone density loss. The other version of the drug is known as TAF.
Even though the early testing indicated TAF was safer with lower toxicity, Gilead stopped clinical research for the drug and did not attempt to bring it to market immediately. During this time, Truvada was earning Gilead as much as $11 billion per year. The lawsuits allege Gilead purposefully delayed researching TAF until the patent for Truvada was running out. This helped increase Gilead’s profits at the expense of its patients because once a patent runs out, generic drug manufacturers can produce the same drug and cut into the Market share of Gilead. By waiting to get TAF approved until the patent ran out on TDF, Gilead effectively doubled the length of time before it would have competition selling its HIV drugs.
During this time, many HIV positive Americans were taking Truvada with TDF and many HIV negative sexual partners were taking Truvada for PrEp without realizing this increased risk. Many of them were Florida residents. The FDA sent two warning letters to Gilead and its alleged that the drug company representatives were making false claims about the drugs safety and downplaying the side effects.
As of this writing the first federal Truvada lawsuits have survived a motion to dismiss. Judge Jon S. Tigar has ruled federal laws and FDA regulations do not bar most of the claims. This is the first step in attempting to hold Gilead accountable. It means Truvada lawyers will be able to continue gathering evidence of Gilead’s wrongdoing.
Florida residents are filing Florida Truvada lawsuits now. If you have been injured by Truvada you should consider using a Florida Truvada lawyer to do so as well. Not only will filing a Truvada lawsuit help hold Gilead accountable for its actions, it will also provide compensation to those injured Florida residents.
